To whom does the Packaging and Packaging Waste Royal Decree apply?

This Royal Decree applies to a wide range of actors in the production, distribution, and management chain of packaging and its waste, with the aim of ensuring sustainable and responsible management of these materials. These include:

  1. Producers and distributors: Manufacturers and distributors of packaged products, who are responsible for assuming the management of the packaging and waste generated by their products.

The Royal Decree recognizes an extended producer responsibility (EPR), meaning they must comply with the obligations established in the regulations, assuming responsibility for the management of the packaging and waste generated by their products, as well as registering with the competent authorities and submitting periodic declarations on the packaging they place on the market.

  1. Waste management companies: These companies are responsible for collecting and transporting packaging and packaging waste from generation points to treatment and recycling plants.
  2. Public administrations: Local, regional, and national authorities have responsibilities in the application and supervision of compliance with regulations, as well as in the promotion of policies and measures to promote sustainable management of packaging and packaging waste. They are responsible for supervising and controlling compliance with regulations by the parties involved, and for imposing sanctions in case of non-compliance.

Packaging Declaration

All producers, in order to comply with the information obligations regarding waste management set out in Article 17 of the Royal Decree, and particularly to collect information on the packaging placed on the market, must register with the Register of Product Producers, inform the Collective System of Extended Producer Responsibility (SCRAP), and submit the corresponding Packaging Declaration.

This reporting obligation also applies to manufacturers, importers, purchasers, or distribution companies of the specified packaging, as appropriate. This report shall be made in aggregate for all product producers who introduce packaging onto the market below the established thresholds.

The Domestic Packaging Declaration includes the calculation of the economic contribution, regarding the packaged products marketed by the company during the last calendar year. This contribution will depend on both the number of packages placed on the market and their weight and material type. The deadline for reporting shall be from January 1 to March 31 of each year.

In the Packaging Declaration, information must be provided on the category of packaging placed on the market (domestic, commercial, or industrial), whether they are single-use and/or reusable, as well as the extended producer responsibility system(s) for which the product producer participates or is affiliated.

In conclusion, this Declaration consists of providing detailed information on the packaging placed on the market during a given year, including data on material type, weight, and quantity of packages used. This information is essential for calculating recycling and valorization rates, as well as for assessing compliance with the objectives established in terms of packaging and packaging waste management.
